Dell Inc. canada falls in lawsuit over “Dell Inspiron Notebooks”
Dell Inc. is now in problem with their “Dell Inspiron Notebooks”, as some of the Canadian customers have sued the company for the delivery of models with defective motherboards. Thad Griffin, an Ontario man, has launched this lawsuit in the Ontario court of Justice, against Dell Canada Inc., on behalf of customers who are facing regular problems of system failure, due to the defects in the motherboard.
The lawsuit claims that Dell was negligent in the design of the computers, and the models had defects which cause complete system failure. They have also claimed for compensation for the trouble caused due to alleged defects in the Dell Inspiron Notebooks, mainly because of company’s careless transaction. Dell Inspiron notebooks: 1100, 1150,5100, 5150 or 5160, are said to be susceptible to overheating and premature motherboard failure and the problems often occur just after the expiration of a one-year warranty. It is also said that Dell knew or ought to have known of the inherent defects in the notebooks’ design but nevertheless sold, marketed and distributed the notebooks in Canada.
According to Joel P. Rochon, a partner at Rochon Genova LLP, a similar U.S. action involving the Inspiron 5150 was recently settled. In that settlement, Dell agreed to provide an extended one-year limited warranty covering certain repairs. Also, U.S. cases involving the four other models are continuing. Thad Griffin, who is the main proposed representative plaintiff from Aurora quoted that he is now forced to spend hundreds of dollars to fix the defective motherboard, when Dell should have known about this problem at the time they initially sold the computer.
An Official from Dell Inc. Canada, in an e-mail prefered not to say anything on pending litigation. She also cleared that, it is not related to the Dell recall of more than four million laptops last summer. The allegation is not still proved in the court.
